Required Prerequisites

The course provides the fundamental elements of public law, understood as a discipline related to the setting up of the powers of the State and other public institutions. The discipline includes elements of the general theory of law and the state, the relationships between the legal system of the Republic, the international and extra-state regulations, the sources of law, the organization of constitutional powers and the guarantees of freedom and fundamental rights.

Detailed Course Content

Elements of General State Theory - State Forms (with particular reference to the fundamental principles of the rule of law and the Social State) and forms of government - The person and the social formations in the constitutional order: rights of liberty and public duties - The system of normative sources: general notions, Constitution and its revision, state, autonomy, community and international sources - Jurisdictional function - Constitutional principles on public administration - Constitutional justice and its application. Organization of the Republic: the electoral body, the Parliament and the functions of the Chambers, the President of the Republic, the Government - Auxiliary Bodies - Independent Authorities - Local and Regional Authorities (the new Title V of the Constitution: 3/2001). Rule of Law and State, constituent parts of the state, State and international organizations, State forms, principles, rights, freedoms and duties in the Italian constitutional order, forms of government, parliament and the President of the Republic.
