Detailed Course Content

Environmental crimes: characteristics of the criminal phenomenon. The “general part” of environmental criminal law. The criminal offences provided for by Legislative Decree No. 152/2006 concerning waste management and clean-up of polluted sites. The criminal offences (felonies) against the environment provided for by Title VI-bis of the Criminal Code. The liability of legal persons and collective entities for environmental crimes. Should teaching be carried out in mixed mode or remotely, it may be necessary to introduce changes with respect to previous statements, in line with the programme planned. Learning assessment may also be carried out on line, should the conditions require it.

Textbook Information

Carlo Ruga Riva, Diritto penale dell'ambiente, Giappichelli, 2016, pages: 14-30; 43-80; 142-186; 219-229; 239-281. Students who will be regularly attending the lectures can study part of the programme on the learning materials that will be provided by the professor during the course; only for these students, the learning materials can be used instead of the textbook, according to the specification that will be given by the professor during classes. All students should consult updated versions of the legal texts relevant to the programme. Indications on the website with free access to the legal texts will be provided by the professor during the course or, for the students not attending the lectures, by e-mail.

Learning Assessment

Learning Assessment Procedures

Learning assessment takes place through an oral final exam. Learning assessment may also be carried out on line, should the conditions require it. The exam will be assessed according to the following criteria: - correspondence between the answers given by the students and the questions that have been asked; - quality and comprehension of the exposed contents; - ability to link different topics of the programme; - ability to provide examples; - ability to use the relevant technical language; - overall communicative skills; - familiarity with legal texts.
